It is unclear if there was a paternity suit and a joint custody order was put in place. Moreover, if he has a joint custody order there should be a support order as well.

I am not sure I understand how he supports anyone without a job, and if he does I am not sure I want to know how he does it.

The usual manner in which a father would give up an right to custody is by entering into an agreement to release his parental rights. However, if he did that he would not be obligated to pay child support in the future.

I suggest you contact an attorney who does custody matters, I do not. I may be able to recommend someone to you.
