Legal Question in Family Law in Massachusetts

My sister is in the Army active duty, because of personal reasons on my part , my sister has offered to temporarily take care of my son, what does she or have to to make this happen.

She will need to be appointed as the legal guardian by a court of competent jurisdiction. Depending on whetehr this is her initial enlistment or not, she may have contract requirements that supersede this plan. Your sister should speak to the Legal Assistance Office in the JAG Office on her military base to review her obligations.

Whether your sister would be an appropriate guardian would depend upon her obligations with the Army. If she could be called up for duty at any time, you may want to consider somebody else.

You will need to go to the probate court and prepare a temporary guardianship form. The rules and procedures have changed, and you may want to hire an attorney to assist you in accomplishing this.
