Legal Question in Family Law in Massachusetts

My sister is the executrix for my mother's estate. She no longer wants the responsibility. How can we appoint someone else? My mother has passed away.

I'm sorry to hear that your mother has passed.

If your sister no longer wishes to serve, someone will have to serve in her place. My recommendation is that your sister, and/or her replacement, retain counsel here in Massachusetts to assist with that transition. If probate has not yet been commenced, then your mother's chosen alternate can petition for appointment. Your best bet is to retain counsel to assist you with the details of filing, especially if you are out of state.

I am sorry your mother passed away.

Your sister, if she has not yet been appointed can decline to serve and ask someone else to serve in her place approved by your mother's heirs and beneficiaries. If she has been appointed she files a petition to be allowed to resign and someone else be appointed.
