Legal Question in Family Law in Massachusetts

Sole Custody or Termination of Parental Rights?

My children's father has not been involved in thier lives. He currently owes over $7,000 in child support. He recently came to my home, knowing I was at work, and confronted his 11 year old son whom he had not seen in well over a year. He told this Child that he has lost Everything..and asks this Child we HE won't visit him. My son called me Immediatly at work..he was confused, and ''felt bad' for him.

This man has no relationship with these children. I have not terminated his Parental Rights only because I want these boys to know

that he always had the right, but never exercised it.

I do not want him to have the right to,

very randomly' Appear into their lives. This is the one thing he has done consistently. It hurts them, it confuses them, and I can't anticipate or prevent it.

What is my best option here? Sole physical & legal, or Termination of his Parental Rights? What is the best route for my children? Again he choses no relationship with either of them.

Re: Sole Custody or Termination of Parental Rights?

This may well be grounds for sole custody. It is definitely grounds for an order clearly preventing him from seeing the children except in controlled circumstances.

I would be happy to consult further, and have an office in Attleboro.
