Legal Question in Family Law in Massachusetts
What are my son's rights regarding visitation?
My child is 12 years old and he has told me repeatedly that he doesn't want to go with his father anymore. His father does not take our son consistently and doesn't do anything with him when he takes him. What age does my son have to be in order to not be obligated to go with his dad? Is there anything I can do?

What are my son's rights regarding visitation?
There is no age which marks the turning point. It is my view that a child of this age does have an obligation to comply with the court ordered visitation. If there is a problem, there needs to be a mechanism to discuss the issue and try to reach a resolution.
The father is not supposed to entertain the son or "do anything." This is contact time.
My suggestion is that you first try to discuss the problem with the father and see how you cam maximize and improve the situation. Then bring the son into this once the discussions are held, and have him add to resolve the problem. If this does not work, you may need some professional intervention.
