Getting Spouse out of House

I was wondering at one point does the other spouse have to leave the house when going thru a divorce. My husband is mentally abusing me and does not want me to divorce him and I can't take it anymore do I have any way of getting him to leave legally I am so tired and I am going nuts he harrasses me everyday. We have one small child 22 months old. Thank you

In Massachusetts a judge can order a spouse out of the house. This can be done in a divorce action, or if abuse is present, in an abuse action. If the abuse is limited to mental abuse, you can obtain a vacate order in a divorce. A judge has discretion and may not give you the order. You should consult an attorney and get assistance.
