ssi and child support

my ex-husband got fired from his job 8 months ago and i no longer receive child support he has been in a rehab facility since his job loss. i am told that he will be filing for ssi in the state of ma. is he required to pay any child support and what happens to any of the back pay that is still owed?

You are asking a multi-state question. Regarding the SSI being filed for in Massachusetts I will have to defer to my colleagues in that state.

However, if your ex-husband's child support order is running based on a Rhode Island Family Court Order and he did not obtain an Order of Modification of his Child Support from the Rhode Island family court that issued the support order, then the child support continues to accrue in Rhode Island and it is still owed to you for the benefit of the child(ren). Without a modification Order from the Rhode Island family court (assuming I have read your situation correctly from the information you provided) then the money is still owed and your ex-husband should still be paying the child support. Getting fired and/or entering a rehab facility does nothing to affect the child support you are entitled to receive.

Unfortunately there is not enough information provided about the SSI application to answer the remainder of your issues.
