Legal Question in Family Law in Massachusetts
Out Of State Court Appointments/Paternity test
Three yrs.ago,I was contacted by Mass.Child Services about a child in their custody. The mother told them I was the childs father.I went to Mass.they scheduled a paternity test. The test was postponed on three occasions.I returned to illinois.A case worker told me I could have the paternity test done in Il.I got tested(Nov.20th,2000)and still, have not been given the results.I have been in contact with The commonwealth of Mass. about the test. They told me,I am not the father or the mother does not want me to know, but they are still checking into it.I was served papers today that say I must appear in mass. court on Jan.16th,2003 for a paternity test and child support judgement. Can i get an attorney for this,do I have to go to mass.in that short notice, and do I get an attorney in my state or Mass? Can I get this court date rescheduled ? I would like to know if the child is mine or not,as soon as possible. The child is 9 yrs. old. If the child is mine, will I be required to pay child support for all the previous years? I was contacted three years ago, when the mother was incarcerated for drugs.I need an answer as soon as possible.

Hello -
In response to your question, you are entitled to be represented by an attorney at this hearing - and I recommend that you do so. My name is Len Foy, and I am admitted to practice in Massachusetts and in New Hampshire. If you are interested in having me represent you at this hearing, please contact me directly at Gould & Gould, 77 Gilcreast Road, Suite 1000, Londonderry NH. Our office telephone number is 603.434.3437. My cellular phone number is 603.978.0421.
If you are going to hire an attorney, I recommend that you do so as soon as possible. The motion for a continuance should be filed as soon as possible, certainly prior to the date of the hearing.
I look forward to hearing from you - Good Luck.

Re: Out Of State Court Appointments/Paternity test
You must retain your own attorney and should do so immediately to contest the January 16th date and request a continuance to a more reasonable date to afford you and your attorney sufficient time to prepare as you could be required to pay support from the date the child was born if you are adjudicated as the father. Should you have further questions feel free to contact me.
