Legal Question in Family Law in Massachusetts

State of MA.

My ex-husband has been ordered to pay child support while our son is in college until age 23. If our son is going to school part time for one term can my ex-husband stop paying child support?

Also when our son turns 23 does my ex just stop sending me support payments or do we go back to court, how does that work?

Also as part of the agreement I was to have the house and make the mortgage payments until our son finished school then is was to go up for sale if the support payments stop before the house is sold I will not be able to make the mortgage payment with only my income and alimony how can I get my ex-husband to start paying half the mortgage payment as he will receive half the profit from the sale of the house?

your husband can seek to stop making payments if your son is only going to school part-time, but will be required to pay again once your son has a full time schedule.

He is not required to make any payments for child support once your son reached 23. He will not be required to pay for university education either.

Your ex-husband can seek to reduce his child support obligation, but only with the permission of the court. Are you interested in selling the property now? Perhaps you and your spouse can agree on a solution that will work for both of you. If you would like some assistance, please feel free to contact my office.
