Legal Question in Family Law in Massachusetts
subject: options for divorce
Wife and I have been separated for 10 months. I have been living with someone who I wish to protect in this process. Wife is not 100% agreeable to divorce. I would like to keep proceeding clean and not get nasty. Two Children, 14 and 20. What are my options ?

Re: subject: options for divorce
In light of the age of your children, your options for a clean divorce are only limited by you and your ex-wife being able to reach an agreement. One of you (most likely you) will need to begin the proceeding. Our office would assist you in the proceeding and help establish realistic expectations for both you and your wife to protect your best interests. Divorce is an emotional event and unrepresented parties tend to act on emotion; making decisions they later regret or discover were not in their best interest. If you would like to discuss the details of your matter, please feel free to contact my office. 978.250.4255 There is no fee for an initial telephone consultation.

From what you wrote it does not seem as if your wife is ready for a joint divorce agreement. However, you can proceed via Complaint for Divorce or Complaint for Separate Support. You may want to consider consulting with a family law attorney to weigh your options.
