Legal Question in Family Law in Massachusetts

I am being sued for child support for a child I never knew about. The DNA test is pending. I just got a summons to appear in court next week. I am living in a different state now so do I have to show up? What are my options as I cannot afford the travel fees. Is this considered a civil case or a criminal case? Can I go to jail for this?

Hello,

If you received a summons to appear in court you are expected to appear on that day. If you do not live in the state and it would be a financial hardship for you to appear you may hire an attorney to represent you and appear on your behalf.

Child support is under the Massachusetts Family and Probate Court jurisdiction. It is not criminal law. If you are ordered to pay child support and do not pay it, then a possible outcome is a jail sentence.
