How many days prior to trial must a person be subpoenaed?

I would serve it at least 48 hours before the trial, and earlier to give them enough time.

Generally, a reasonable amount of notice should be provided (30 days). However, in certain situations where a witnesses name was just discovered or other circumstances occur that prevented the attorney from timely issuing the subpoena, exceptions can be made. This is up to a judge. You should always answer and respond to a subpoena unless there is an extremely important reason that you are unable. You may be able to quash a subpoena by filing a Motion with the Court.
