unmarried father rights

hello i am a unmarried father and i can prove by birth certificate. my ex girl friend just told me that she is writing out a last will and testiment. now she says if anything ever happens to her that her parents will be getting both her kids(one child in mine the other father is a friend of mine well used to be), i want to know if she can actually do that legall custodianship and custody and that have not been set, but she and have a verbal contract on child support and visitations, my other question is, I pay for and provide my child with medical benifits but i need her consent to make any medical choices does that sound right? i understand that the judge will look into the living conditions the child will be in and sibling seperation and what is in the best interest of the child. but i need some clearification on these matters please help me.

If you want legal rights to this child, then you must get a court order to say that you and your ex have shared legal custody of the child. She can retain sole physical custody but you must have some legal custodial rights.

To obtain shared legal custody of the child you must file a paternity action and acknowledge paternity and seek a court order of shared legal custody. Good Luck!
