video taping

can I make a video tape of my child and her mother without the mother's explicit permission? she says I am in violation of the federal wiretapping laws if I do this. I want a record of my visitations with my daughter, that's all. the videotape machine is in plain view and we are meeting in a public place.

You can take any pictures of your daughter, suing any means that you want.

I am not sure why you would want to take pictures of the child with her mother. I do not see this action of taping in public as being under the wire taping provisins of state or federal law.

Now if the mother explicitly refuses, there should be a valid reason. The analogy is that private investigators often video tape others, and that is not a violation.
