Legal Question in Family Law in Massachusetts

visitation not happening

If my husband chooses not to pick up his son due to the son being a danger to the children that live with us and the mother is not addressing the issue(we live in a different state too far for us to) with the md is there anything that can be used against us. Is he in contempt for not visiting with his son.

No to the second sentence.

Husband is not in contempt. Mother is in neglect if the child is not being properly medicated or cared for. Your husband should take pro=-active steps, starting with notifying the MD, possibly notifying DCF ("social services"), and possibly filing a case with the court here to force mother to look after son. Yes, this is a tough situation, especially given the distance, but both parents need to start addressing son's apparent issues.
