If you are the biological father of the child, the law gives you the right to visit your child. In order to exercise that right, you need to first establish your legal paternity. If you signed an acknowledgment with the mother in the hospital when your child was born, then that is all set. If not, then you need to sign an acknowledgment with the mother. You can do that at the clerk's office in the city or town where the child was born. If the mother is not willing to sign the acknowledgment, then you can file a complaint to establish paternity with the probate court in the county where you live. You can include a request for visitation in the complaint. Genetic marker tests may be ordered. If paternity is established by acknowledgment, you can file a complaint with the court to establish a visitation schedule. Since the mother has custody, the court will likely order you to pay child support. Good Luck.
