Legal Question in Family Law in Massachusetts

Waiving the Nisi period

Is there any way in Mass to have the Nisi period waived after the court approves the seperation agreement. It is an uncontested divorce with all of the matters resolved and absolutely no chance of reconciliation so I was wondering if there was a way to just get a final decree after the hearing is over or after the 30 day Decree Nisi instead of waiting the 120 days. I am currently deployed in Afghan with the US Army and going through the divorce process from over here and I would like to have the whole process done as quickly as possible so my ex and I can move on with our lives and not have to wait any longer.

Re: Waiving the Nisi period

Unfortunately, the short answer is "nope." Basically, the nisi period is a holdover in case you go through the divorce and then have buyer's remorse. On the other hand, the only real effect of having to wait is that you can't remarry (or in your case, to get a certified copy of the judgment to give to DFAS) until after the nisi has passed.

And stay safe over there.
