Legal Question in Family Law in Massachusetts

Ex wife had baby and it is not mine

Here's the situation. My boss had been seperated from his wife since March 2005, she had several affairs. They have been divorced since September 2006 he has custody of his child and she has to pay 80.00 a week in child support which she does not she recently had a child and does not know the name of the father so she stated that it was her ex-husband. The department of Transitional assistance said she must state a child father's name or she will not receive assistance. The gentlemen at the Welfare Department says that he is responsible and could you tell me what the law says about this situation and what should he do she had a one night stand with someone and does not know his name. He almost filed Alienation of affection and adultry but decided to b nice and just filed irreconsible differences.

I am not sure your level of involvement with your boss.

If your boss is concerned about what actions or defenses he has against this child being labeled as his, and if he is sure that the child is not his, then there are ways to deal with this issue. One of the them is as Mr. Weicker said.

Your boss should really consult an attorney to discuss this and to decide what actions, if any, he should take.

He can contact me for such a consult.

He needs to bring a motion before the court and demand a DNA test; he should consider being represented by counsel as this is a permanent decision. Contact me if you wish to discuss further
