Legal Question in Family Law in Massachusetts

Wife cheated. Two kids (14 & 7). Live in Massachusetts. I have no money to get the ball rolling on a divorce and the house (purcchased during marriage) is in her name. Am fearfful I'll end up living in a car unable to have a place to care for my children unless we sell the home and split the proceeds. How can I make this happen?

After a review of your financials, our firm may be able to represent you on a deferred fee basis, or perhaps a low hourly/deferred fee combination. Assuming that your marriage is at least as old as your children (you don't mention), the marital estate is presumptively going to be divided roughly equally, although the court will consider a number of factors in making a fair division of the estate. The fact that the home is in her name does not mean it is her home.
