my wife and i are not quite divorced yet, but the paperwork is filed and waiting for a date. My question is does she have the right to move out of state with my daughter without my permission?

Once a divorce action is filed, neither party can remove a child from Massachusetts without permission of the other parent or a judge.

No, she can not remove the child from the state without the court's permission or yours once the divorce is filed
