My wife is in India. I am in USa. I have filed a suit in India for divorce.

My wife is coming here in USa. Can I file another suit in USA .

You could dismiss your case in India and refile here in the United States. You don't mention whether your wife is moving to the US on a permanent or temporary basis. If your wife is only visiting the US, you may be better off maintaining your divorce suit in India.

You could dismiss the lawsuit in India and refile here. It will however depend on both of you having lived in MA a sufficient amount of time and if she is simply visiting or going to live here.

I would suggest you contact a MA attorney and discuss the options with full facts.

In Mass., you would have to notify the Court of the pending action or even prior action.

You must file in the Court with jurisdiction.
