Legal Question in Family Law in Massachusetts

My ex wife and I separated last September. We lived together throughout the whole 9 months. We have two kids together. I paid half the rent and helped with the utilities. She is not letting me claim any of my kids on my taxes. What can I do?

Thank you for your question. I'm sorry to hear you are going through this.

It sounds like you are currently living apart, but it is not clear that you are divorced. If you are not divorced, but are interested in becoming divorced, then you should retain counsel to file a complaint for divorce against your spouse. Upon filing for divorce, you can request that temporary orders issue from the Court concerning custody, support, and other matters while the divorce is pending. If you are already divorced, and your ex-spouse is in violation of the Court's order of divorce or your settlement agreement regarding the children or any other matter, then you need to file a Complaint for Contempt.
