Legal Question in Family Law in Massachusetts

wilfully violation of child support order

I received a summons where my ex filed a complaint for foreign modification. He has not paid child support for our three children ever... over 10 years. His claim is that he didn't know he had to pay support ... untrue, the arrears should be dismissed and that because 2 of the 3 children are over 18 he should only have to pay for the one minor. I need to answer his summons and was wondering if I can counterclaim for wilful violation and what the penalty is for that claim.

Re: wilfully violation of child support order

Yes.You can counterclaim for contempt of court if the support order was served upon him such that he had knowledge of it. The penalty could be back arrearages plus interest and attorney's fees. Good luck!
