Legal Question in Family Law in Massachusetts

Will

We have one son and we would like to work on a will to ensure my siter receives custody of him in case anything happens to us.

However, she lives in Brazil and we would like our sin to be raised here. Could she move here legally to raise him if she was to take care of him until he turns 18/21?

Re: Will

THis is overly complex, and may require the involvement of an immigration attorney.

Re: Will

It is not likely that being a gurdian to your son would allow her to move to the US.

You can name her, but that will not assure you that she will be permitted to live here and raise your son.

If she lives in the US now, she can start the process for filing for US residency. Once that is granted you can name her and she can stay here and raise your son.
