Legal Question in Family Law in Massachusetts
My x- husband got on disability. i know he is frauding i have pics of him working, he riding the roller coasters at 6 flags, rafting, and cutting down trees in his yard, and other things. we went to court because he was not paying his child support. we were last in court on june 1. the judge said that there was a benefit i could collect. i had spoke to someone from disability prior to court and i was told that if he gets caught frauding that i would be responsible for paying the money i recieve back if he gets caught frauding. dor and the court encouraged me to look into it further and take the money. so after court i did just that. i called and spoke with a few different people. including a supervisor who told me i could sign a no fault waiver, and collect the money w/ out any worries. i have since accepted the money. i sent him a certified lettertelling him i was going to collect the money and that he could take me back to court to lower the child support, so that it meets the guidelines he has not had me served is it my responsibility to file the papers and have him served?

No-if he wants the c/s lowered he has to file.
