Legal Question in Family Law in Massachusetts

I have a three year old son since he was 6 months old he has stayed with my girlfriends uncle due to the fact that my and my girlfriend were on drugs now we are off drugs and her uncle is saying we cant take him with out a court fight what are my legal rights
