Legal Question in Medical Leave in Massachusetts
questionable actions by my employer
I have been on Maternity leave and Oct 6 was my planned return date to work. Via email documentation, my boss granted me another month unpaid leave. My company pays for 8 weeks maternity leave. On Monday of this week (7 days before the 12 week point) my boss called me to let me know that I would now be reporting into someone else and he would have the responsibilty that I had prior to my maternity leave. I asked him what my role would be and he said 'I do not know, there is enough work to do'. In addition he said I needed to contribute to defining the roles. I stated I had concerns about my career development with this change and he said he does not believe it is affected. Although I have not had a change in rank (I am an Assoc Director) or pay, I did have a change in my job / responsibilities. The Director I will now be reporting to is a man with with no expertise to support the clients I was responsible for supporting. I have far more experience and have recieved recognition for my job performance with excellent reviews, confidential retention bonus's, outstanding contributor awards, etc. Is this legal as it pertains to FMLA and gender discrimination? I have been with this company for 12 years.
