Legal Question in Medical Leave in Massachusetts

I recently was laid off due to "job elimination" and restructuring. However I believe it was retaliation from my new supervisor when I requested FMLA time due to the birth of our 2nd child. he told numerous times that it was frowned upon especially for the father of a newborn. 1 week after my last verbal request to my supervisor I was let go suddenly and without warning saying it was due to job elimination. however, my job was posted 1 on the Internet same title and responsibilities. I received 3 months severance do I have a claim?

An employee who signs a severance agreement gives up the right to pursue most claims against a former employer. Besides a possible fmla claim you also likely had a right to unpaid paternity type leave under state law. Feel free to call or email me to discuss further.

It sounds like you have a good case for FMLA retaliation. I recommend: Attorney Howard I. Wilgoren in Boston. (617) 523-5233.
