can the attorney of record in a massachusetts divorce case file a civil contempt charge for arrears only in child support with out the mother being present for the hearing this is my now wife divorce and we now reside in north carolina so it would be and unneccessary hardship

The complaint for contempt can be filed, but your wife will need to provide testimony at the hearing. If you schedule the hearing in advance, you may be able to get decent airfare. Another alternative might be to go thru your current state's Child Support Enforcement Division.
