Legal Question in Civil Litigation in Massachusetts
Auto Accident
Roughly 14 months ago my girlfriend's brother used her car without her permission which resulted in an accident. After considering her options she decieded not to pursue criminal charges against him for theft due to the fact that he agreed to fully pay for the damages, which of course he's yet to make good on and seems determined not to. As a result, this brings me to my question of what leagal option(s) does she have to recoup her money from her brother for the damages caused by his accident.

Your girlfriend can file suit under tort theories which will require the brother to pay any and all damages that can be proven. She may be able to use the small claims process.
