Legal Question in Civil Litigation in Massachusetts

Bounced Checks from a Temp agency

My Son worked for a Temp service. He was notified by his bank that 3 checks out of the 5 checks that he deposited to his account were returned from the Temp services bank and were marked insuffient funds. He is also being charged $30.00 per bounced check. He has two more checks that he has deposited from the Temp service and we are pretty sure that they will be returned also. After numorous calls and promises of a refund the two men that he has contacted at the Temp service are doing nothing but giving my son the run-a-round. My Husband called the Temp service and got no furthur than my son did except the fact that my Husband told them that he would be seeking other means in getting this issue resolved. These people promised my son a refund today (May 13th) and no refund was actually issued. My son heard that this Temp service is trying to file chapter 11. But our question is can these guys continue to do my son and others wrong? What can my Son do and the others he knows who are dealing with this same issue. Your help would be greatly appreciated. Thank you.

The failure to pay wages - even with a bounced check - falls under the jurisdiction of the Massachusetts Attorney General. Contact the Fair Labor Practices Division of the Massachusetts Attorney General and file a complaint. If the company files bankruptcy, contact a bankruptcy lawyer who might be able to guide you.
