Breaking School Tuition Contract

My wife and I signed an elementary school contract for my son's school back in February, which states that we are responsible for his full tuition for the next year, and we paid a $500 deposit.

We decided over the summer that we can not afford to keep him there, and want to send him to attend another school in the Fall. We have told the first school of the change, and they insist the full tuition is due anyway.

Do we have any chance of not owing this in full?! The idea of paying for schooling that he will not receive is very upsetting.

Attorney Davis's question is critical. Does the contract allow for a date by which you must either (a) cancel, or (b) pay up?

If there is no such date, you should attept to fight this on the theory that they are being unjustly enriched.

In any event, you are likely not entitled to a return of your deposit.
