Legal Question in Civil Litigation in Massachusetts

Collecting a debt.

I took out a loan for someone in the amount of $4,000 and have a copy of the agreement drawn up but cannot find a signed copy. It has been almost 10 years and the individual has not repaid me. What can I do?

If you were to find the the promissory note, you might possibly have up to 20 years to collect, as opposed to 6 years, if it was notarized. If you can't find the promissory note, I agree with Attorney Lebensbaum's comments.

I think this has turned into a gift. There is a 6 year statute of limitations, with some exceptions. Usually, this starts from the last payment.

ok?
