Legal Question in Civil Litigation in Massachusetts
Cosigner Responsibilities
My relationship has ended with my fiancee. He has left the state with both, a motorcycle and our car with my name on both. He will not return my calls. I own my home, and what would happen in the event of an accident by him in another state? What or how can I get off these loans?? I'm so upset about this. I feel that I've got to have some rights here!! H E L P

Re: Cosigner Responsibilities
Before taking any further action, you really need to be sure exactly whose name is on the title and who is responsible for the automobile loan.
If the automobiles are titled in your name only, you should probably report them stolen to the police and your insurance company.
If you are a cosigner on the automobile loan, make sure you continue to make payments on the automobile to protect your own credit and to keep them from coming after you for the loan balance.
As far as protecting yourself and your home from liability, you should probably consider recording a declaration of homestead with your local registry of deeds to protect your home from creditors and in the event that your fiance injures another person in a car or motorcycle collision.
