Legal Question in Civil Litigation in Massachusetts

demand notice

My 14 yr. old grandson was with my 18 yr old son who shoplifted at a local Wal-Mart. Although my grandson didn't take anything I received a letter asking for $200 dollars. I was not called to the store by securith because the 18yr. old signed for him. Is it fair that I have to pay even though he didn't have anything?

I would refuse this claim. You are not your GRANDSON's keeper (unless you are his guardian as a matter of law), nor your adult son's. Even if you're your grandson's guardian, I'm not sure what theory allows Wal-Mart to charge you the cost of detaining him. Other attorneys, please feel free to step in if such a legal theory exists.
