Legal Question in Civil Litigation in Massachusetts

Deposit Refund

I placed $100 deposit to rent a

room for a birthday party. The

woman told me I had a couple of

hours to decorate and only 3 people were allowed to be there.

She calls me a few days later and

asks if I could decorate in an hour.

She had someone who wanted to

rent from 1-5. My time was 6-1.

I found another place to rent and

canceled her. She only gave me

a receipt for the $100. I did not

sign anything. She spoke nothing of nonrefundable deposits. Can I get a refund?

Re: Deposit Refund

Based on what you've written, assuming you gave her adequate notice about the cancellation, it sounds to me like you should be entitled to a refund.

Re: Deposit Refund

You gave the deposit relying on her representation that you'd have 3 hours to decorate. Only 1 hour was not enough for your purposes, and not what you agreed to when you gave the deposit. Since the arrangement was no longer acceptable to you, you were entitled to cancel and the refund of your deposit.
