failure to return personal property

a relative took stock certificates that were in solely my father in laws name with her as the beneficiary. She refuses to return them to him. The stock company will not replace them because technically they are not lost. What is our next move to have them returned to the rightful owner?

Call the police and file a report of stolen property. If they will not retireve the certificates, go to the distrct courthouse and swear out a criminal complaint.

You need to file a suit in equity demanding the return of the stock certificates. In addition, your father should be advising the company that he revokes her beneficiary status, if such is revocable.

He should also claim that they were stolen, report it to the police. The police may or may not take action. You could then ask the company to replace the stolen certificates.
