How do I find out if the other party has a lawyer?

I am the Plaintiff in a Small Claims case that was appealed by the Defendant. My case will be tried in front of a jury on December 27, 2006 in Lowell (MA) District Court. I did not even think about hiring a lawyer to represent me. Is there any way to find out if the Defendant has hired a lwayer for this case?

Call the Lowell District Court and ask if anyone filed an appearance for the otherside (have your docket number and names of the party ready when you inquire. The prior attorney gave you the other ways to find out. Keep in mind, an attorney can file his appearance right before the hearing/trial and the court would not find out until that moment!

Good advice there. You could also try to settle the case with the Defendant before the trial if you feel nervous about the outcome.

How do I find out if the other party has a lawyer?

Small claims is a different beast.

There are 3 ways you may find out.

1. A layer files and appearance or sends correspondence to the court.

2. You ask the other side, and they tell you.

3. You find out on the day of the trial.
