If an employee is on a maternity leave under the Massachusetts Maternity Leave Act, and is given the option of using accumulated sick leave days during that time, can FMLA be imposed from the first day of ''disability?''

You are getting into mixed terms with your question. Maternity leave is not necessarily a 'disability' unless there is an accompanying medical issue (non-ordinary maternity leave). Contact me and we can work through the specifics of your question(s).
