Legal Question in Civil Litigation in Massachusetts
I and a friend went to an electronic store and parked on the street side of the store just below the sign the said "parking for XXX electronics only" in clear view day-light.....not a bad neighborhood at all. When we returned to the car we noticed that someone had attempted to brake into my car and caused a good amount of damage. When I approached the store manager to see if they had any video of the incident he became defensive and told me no and they were not responsible.
When I returned again I notice auto-glass everywhere in the parking lot (took pictures) and walked around the building to see if they had video cameras and out of all sides of the building this was only side that didn't. I filed a police report and reported to my insurance company they had other reports on files.
I sent a letter to their headquarters and there response was they were not responsible.
I am considering suing them small claims for the damage to my car not because I think they directly caused it but because they not protecting their customers. I can think of any reason that they don't have a camera on one side....they even sell video cameras.
What are my chances of winning on this argument?

In my opinion, your claim would be completely baseless.
