Legal Question in Civil Litigation in Massachusetts

hire landscaper a month and a half ago gave him down deposit and another deposit to do a job now the guy is ignoring my calls ive called many times still on the same issue i send him email he answers by saying i will be there this week or friday he has done probably 5% of the job and i left him an email to give me back the deposit still no answer what should i do

Call the police - this is theft/Larceny; You can also file a small claims action, assuming it is under 2,500$
