I hired a plumber to fix something in home. After 5 hours and charging me $400 the problem isn't fixed. Do I have the legal right to demand my money back as he didn't perform the job I hired him to do? Also after the job he informed me that he wasn't familiar with fixing what I hired him to do.

You have an absolute right to have the problem fixed correctly or a full refund. You may have to sue him to get a refund, but you may wish to speak to the Attorney General's Office. M.G.L.c 93A, gives you a number of rights (Google this). You should follow the 93A Demand Letter format prior to suing this individual.
