Legal Question in Civil Litigation in Massachusetts

Landlords Rights

My tenant lost her job and failed to pay rent for about 6 months. She has three children an had been a decent tenant. Sometimes late ,sometime half payments. Promises Promises, finally had them move out with a promise to pay back slowly . They owe $7,800 and promised $200 a month.. no payments even with threat of legal action. Too big for small claims? Shoild I bite the bullet and settle for $5000 if possible or pay a lawyer and try to squeeze money out of these freeloaders. I felt I was being a good person letting this go but now money myself? Thanks for listening , Susan

Re: Landlords Rights

Hi Susan -

It strikes me that it's enough money so that you'd like to handle it the right way - small claims court has jurisdictional limits which could restrict your recovery.

I practice in NH and Mass. (we have an office in Methuen), but certain parts of Massachusetts are beyond my geographical reach (Cape, Islands, Berkshires, etc).

Our office telephone is 603-434-3437 if you're interested in a consultation.

Regards & Good Luck -
