Legal Question in Civil Litigation in Massachusetts
I live in a low housing property in Greenfield, Mass. and it is Tenant owned and private property. I recently had to get a no tresspassing on a quest of a tenant who was harrassing me. From what I have found out he is still on the property. The management co. signed the No Tress. and the sheriff delivered it to where he has been staying, yet the police wont come and arrest him. I was told that the management company has to call the the police since they signed it. But I told them that I was the one who paid for the No Tress and to have it delivered. Numerous police have told me that if he is on the property that he will be arrested. If he is in any common area he will be arrested. They came once for him in the beginning but he had hid or went out the back door. Now they are saying they cannot come. I dont understand at all. There are other people who are No Tress'ed from the property and I asked them what the difference was and they said because they went to court. I could of gone to court also. And in our lease and bylaws tenants have to have control of their quests at all times. It's not making any sense to me. Two police say one thing, and another says another. Someone PLEASE help! I want this person arrested since the No Tress. pertains to the whole property. Thank you.

Ask the management to call the police or the next time you see the person call the police.
If harassment is continuing, go to court and get a civil restraining order.
