Legal Question in Civil Litigation in Massachusetts

Motion to Vacate ????A Civil

A Civil matter in which I was the defendant was closed/dismissed after a judgement was entered in my favor when the Plaintiff ''failed to appear'' at a Case Management Conference.

The Plaintiff subsequently filed a ''Motion to Vacate Judgement'' claiming that he forgot about the court date. He is asking the court to schedule a hearing on the motion on 2/21/2002 (his typo...).

Can I file a Motion stating my oppositon to his request

and ask the court to deny his motion ?

How should I proceed with this filing?

Thanks in advance for your help with this matter.

Re: Motion to Vacate ????A Civil

You do not say what court the case is pending in-Superior, District. In any event, call the Clerk's office, indicate you are pro se and ask what to do
