Legal Question in Civil Litigation in Massachusetts
Is this part of a medical record
Long story, short version, I had a friend who was acting strangely, I was really worried, she was having fits of rage, and I thought she was having trouble with her anti-anxiety medication (clonazipam). Out of concern, I called her doctors office who was prescribing the medication, I spoke with the receptionist, explained what was going on, the receptionist took notes, and told me she would give those notes to my friends doctor. It seems now I may have to go to court in a civil matter where the phone call I made to the doctor office is extremely relevant , can the notes made by the receptionist from information given to her by me (by phone) be used in court? The receptionist wrote down word for word what I was telling her. Or does this violate some type of Dr/patient confidentiality, even though it wasn't doctor/patient, it was concerned3rdparty/receptionist.
Any information greatly appreciated.

Yes - it is part of the record, and the issue of confidentiality lies with the patient.
