If the auto's insurance and your homeowner's insurance both refuse coverage (your homeowner's should NOT refuse coverage), you can always ask the District Attorney to seek a restitution order; however, this may take a long time to see any money of the person is incarcerated or indigent. Best course of action is to press homeowner's policy to cover the loss that you have been paying them to insure... insurance company can go after the driver and play collection agent.
