Legal Question in Civil Litigation in Massachusetts

Property left behind

WHen I moved into my new apartment, the prior tenant left behind a lot of his stuff. Included in this was a couch. He left a note saying that if we did not want to buy the couch from him he would come pick it up. It is now 4 months later and now he wants to pick up the couch? By this time we had assumed that he no longer wanted the couch. It seems to me that he just used me for 4 months of free storage. He has had a lawyer contact me and I am wondering if it would be worth it to have this matter taken to court or if I should give the couch to him.

Re: Property left behind

Tell him that the couch will be on the front on the day of garbage collection, so it will be either picked up by him, or by someone else. Let him know what time the couch is going to be placed outside.

Personally, the prior tenant sound like a presumptous SOB

I don't know whay a lawyer contacted you but it doesn't sound like you should take this to court-you'll spend a lot of time over a very low damages issue. Give him the couch
