Legal Question in Civil Litigation in Massachusetts
release of claims
What if the plaintiff won't sign a release of claims in order to pay off a sm claims settlement? Can I send them a check and state that if they cash it they are releasing me from further claims?

: release of claims
The Plaintiff is required to inform the court that the amount is paid, once the plaintiff receives the payment.
That is the sole action that is required.

Re: release of claims
Generally, yes. Unless the debtor expressly indicates that s/he does not construe cashing the check as a release/final settlement of the claims.
