Legal Question in Civil Litigation in Massachusetts
Restraining Order
This isnt a sexual harassment question but more of a harassment question. What are the conditions or reasons someone would get a restraining order. My situation is this: Met someone on-line, through the personals. Later found out he was married, his wife called me and told me he has a criminal record ect. I told her I didn't know of any of this. I wrote him an e-mail basically telling him to get lost. The wife has called me twice, and now sends me instant messages on the computer. I am now somewhat afraid, as I don't know these people. Her messages are somewhat threatening and enough to make me be concerned. Please advise as to what I should do. Thank You.

Re: Restraining Order
There are two ways to get restraining orders in Massachusetts. The type commonly thought of is available without cost when there is abuse in a relationship between family members or people with a substantial dating relationship. Your relationship does not meet these requirements. While there is talk in the legislature about changing the law, no change has occurred yet.
The other type of restraining order is available in a court of equity such as superior court and is based upon traditional concepts of injunctions such as irreparable harm and no remedy at law. You may be able to get this type of restraining order but there will be filing fees and costs.
